Specific Terms and Conditions for the Be-Present App

• Be-Present is a mobile app designed by Peritos Solutions that tracks and manages your attendance. We share your concern about the protection of your personal information. This privacy policy describes how we maintain the privacy of the personal information we collect online through our Website or App. Our registered customers have the full right to know what information we collect and how it is used.

• Our Policy applies to all the services and products we offer and is based on the principles of security, choice, notice, access, data integrity, and enforcement. When you accept our Policy by registering on our App, you give us consent to collect the required information. You also grant us permission to use and disclose your personal information by our Policy.

Acceptance of Agreement 

The agreement to use this App refers to the agreement between the User and the App owner (i.e., us) for using the App. This agreement matters for all content, products, services, and subjects related to the App. We reserve the right to amend the contract at any time according to our requirements without sending any notification to the users. Whenever the agreement is amended, the new deal will be posted on the Website / App, and the User is expected to read the agreement before using the App. 

Privacy Policy 

The privacy policy of the App has been mentioned on a different page. When you accept our Policy by registering on our App, you give us consent to collect the required information. You also grant us permission to use and disclose your personal information by our Policy. Using the App, you also agree to abide by our terms and conditions. Registration 

When you register on the App and make an account, you agree to the following terms: 

• Providing complete, updated, and exact information in application and registration forms 

• Keeping it password-protected 

• Maintaining and updating registration data and other information submitted by you 

• You are responsible for the risk of unauthorized access if someone uses your ID and password to log in to your account. In such cases, the User will be responsible for any activities and charges levied on the Be-Present account. 

Copyright 

The content, graphics, magnetic translation, digital conversion, design, and similar matters used in the App are protected under applicable copyright and trademarks. The User cannot copy, use, publish, or distribute these App elements until it is allowed under the agreement. 

Restrictions and Prohibitions of Using the App 

The User’s license for using and getting access to the App and its content is restricted under the following conditions – 

1. Copyright 

• The User is restricted from displaying, republishing, transmitting, renting, selling, leasing, or making any other use of the App or any portion of the App. 

• The User may not use the App or its content to develop any database, information, or storage system to be distributed commercially. Also, the information from the data of the App cannot be used for any further sales, leases, subscriptions, or licensing. 

• The User cannot create derivatives or compilations of the App contents. 

• The User is not allowed to use the App’s content by infringing any copyright, proprietary right, or property right of the owner. 

• Removal, change, or obscuring any copyright notice or terms of using the content of the App is prohibited. 

• Use of any manual or automatic process for extracting information from the App is not allowed. 

• Availability of any portion of the App through the internet by any technology in the present or future is prohibited. 

• Removal, decompiling, disassembling, or reversing the App software or using any network monitoring for determining the architecture of the App is prohibited. 

• Using the App for the collection or transmission of the information is prohibited. 

• Unsolicited Emails for commercial purposes are prohibited. Emails with invalid domain names, misleading addresses, or headers are prohibited. 

• Export of the App by violating the export control laws is prohibited. 

• Using the App in a way it causes a violation of any law or rule is prohibited. 

2. Linking to the App 

The User cannot provide links to the App until the User follows these conditions – 

• The primary App of the User should not be indulged in pornography or any malicious or unlawful content. 

• The User does not obscure or remove the App’s copyright notice, terms, and advertisements. 

• The User agrees to discontinue the links of Be-Present to their App immediately if requested by the App owner. 

Advertisers 

Advertisements and sponsorships are allowed in the App. Advertisers and sponsors will ensure that the ad material submitted on the App complies with all the applicable terms and laws. The owner is not responsible for any inaccuracy, problem, error, or illegality in the advertisement or sponsored content. The rights of refusal to accept advertising are reserved with the App’s owner. 

Errors, Corrections, and Changes 

Despite our best efforts to keep things fool-proof, the App can have some errors, defects, malware, and harmful elements, and we will take all steps to rectify them. The owner can change the App’s features, contents, and functions according to the requirement without any prior notice to the users. All the rights to edit or delete the documents are reserved with us as the owner. 

Third-Party Content 

For any third-party content appearing on the App, the owner is not responsible for errors, mistakes, falsehood, pornography, illegal content, or misstatement of facts or laws. However, we will take corrective action as soon as we notice the same.

Unlawful Activity 

We reserve all the rights to investigate complaints and reported violations of the terms mentioned herein. We can further take appropriate action against the suspected unlawful activity. The steps involve reporting such activity to law enforcement officials and regulators, disclosing personally identifiable information to investigation officers and law officials, and other remedies as available under applicable law. 

Indemnification 

The User agrees to indemnification, defending and holding us (the owners of the App) and its partners, officials, agents, employees, successors, assigns, contractors, and third-party suppliers of documents, advertisers, service providers, and affiliates, harmless from the claim and expenditure, loss, and liability along with the reasonable fees of attorney; in case you face any legal issues on account of the usage of the App. 

Non-Transferable Rights 

The User’s right to use the App is not transferable. Thus, any password or right to access the App’s contents given to a particular user cannot be transferred to someone else. 

Disclaimer 

Despite our best efforts to keep things fool-proof, the App can have some errors, bugs, faults, mistakes, and problems. We and the related parties are not responsible for any direct, indirect, situational, incidental, or consequential damage from using the App. Affiliated parties and we are not liable for the User’s information and service use.

Use of Information 

As a user, you acknowledge that you are responsible for the material submitted by you and for the legality, originality, reliability, and copyright of the Be-Present App, not the owner. 

Third-Party Merchant Policies 

All merchants’ policies, rules, and terms will be applied to the User in any merchant App. The owner of the Be-Present App will not be responsible for the information provided to the User by the merchants. The owner of the Be-Present App and its merchant should be seen as independent contractors, and neither party is authorized for any commitment on behalf of another. 

Copyright 

We respect the intellectual rights and property of others and expect the same from our registered users. If the User thinks that any content or document of the Be-Present App has been copied in a way that infringes the copyright, the User should provide the following information to us – 

• A description of the copyrighted work which is claimed by the User to be infringed 

• Physical or electronic signature of the authority to act on behalf of the copyright interest’s owner 

• Description of the location of the content in the App which has been claimed to infringe the copyright

• Address, Email address, and telephone number of the person who claims infringement of copyright 

• A statement by the person who claims infringement of copyright regarding the belief that the copyright owner or any of its agents is not authorized for the disputed use 

• A statement by the person who claims copyright infringement regarding being the copyright owner or acting on behalf of the copyright owner and the information is accurate in their notice. 

Legal Compliance 

The User agrees to comply with the ordinances, statutes, and domestic and international laws applicable while using the Be-Present App and the content and documents of the App, including these terms and conditions. 

Press Releases and Information 

While we are not obligated to, we will update press releases and information on the Be-Present App on a best-effort basis from time to time. Our users are requested to only rely on information updated on our App and not on any such information about us published by other companies.
